RIGHT TO WITHDRAW FROM THE CONTRACT (RETURN):

Subject to point 10 of this chapter, a customer who is also a consumer or an entrepreneur with consumer rights, who has concluded a distance contract, may withdraw from it without giving reasons, by submitting an appropriate statement within 14 days. To meet this deadline, it is enough to send a declaration of withdrawal from the contract (template below).

In the event of withdrawal from the contract, the sales contract is considered void, and the consumer or entrepreneur with consumer rights is obliged to return the product to the seller or hand it over to the person authorized by the seller for collection immediately, but not later than 14 days from the date on which he withdrew from the contract. unless the seller offered to pick up the product himself. To meet the deadline, it is enough to return the product before its expiry.

A consumer or entrepreneur with consumer rights is responsible for the reduction in the value of the product as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the product. In order to establish the nature, characteristics and functioning of products, a consumer or entrepreneur should handle and check the products only in the same way as they could do in a stationary store.

Subject to points 6 and 8 of this paragraph, the seller will refund the value of the product together with the costs of its delivery using the same method of payment as used by the consumer, unless the consumer or the entrepreneur, on the consumer's rights, expressly agreed to a different method of return that does not bind come for them with no cost. Subject to point 7 of this chapter, the return will be made immediately, and no later than within 14 days from the receipt by the seller of the declaration of withdrawal from the sales contract.

If the consumer or entrepreneur with consumer rights has chosen a product delivery method other than the cheapest standard delivery method offered by the seller, the seller is not obliged to reimburse them for additional costs incurred by them.

If the seller has not offered to collect the product from the consumer or entrepreneur himself, he may withhold the reimbursement of payments received from the consumer until he receives the goods back or until the consumer or the entrepreneur delivers the proof of its return, depending on this which event comes first.

A consumer or entrepreneur with consumer rights, withdrawing from the sales contract, in accordance with point 1 of this chapter, shall only bear the costs of returning the product to the seller.

The fourteen-day period during which the consumer or entrepreneur with consumer rights may withdraw from the contract is counted from the day on which the consumer or entrepreneur with consumer rights took possession of the product, and in the case of a service from the date of conclusion of the contract.

The right to withdraw from a distance contract is not available to the consumer or entrepreneur with consumer rights, in the case of a sales contract:

in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specification or serving to satisfy his individual needs,

in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the packaging has been opened after delivery,

in which the subject of the service are items that after delivery, due to their nature, are inseparably connected with other items,
-
in which the subject of the service is a service, if the seller has fully performed the service with the express consent of the consumer, who was informed before the commencement of the service that after the service is provided by the seller, he will lose the right to withdraw from the contract,
-
in which the subject of the service is an item that deteriorates quickly or has a short shelf-life.

RECHT AUF RÜCKTRITT VOM VERTRAG (RÜCKGABE):

Vorbehaltlich Ziffer 10 dieses Kapitels kann ein Kunde, der auch Verbraucher oder Unternehmer mit Verbraucherrechten ist, der einen Fernabsatzvertrag abgeschlossen hat, diesen ohne Angabe von Gründen durch eine entsprechende Erklärung innerhalb von 14 Tagen widerrufen. Zur Fristwahrung genügt die Absendung einer Rücktrittserklärung (Muster unten).

Im Falle des Rücktritts vom Vertrag gilt der Kaufvertrag als nichtig und der Verbraucher oder Unternehmer mit Verbraucherrechten ist verpflichtet, die Ware unverzüglich an den Verkäufer zurückzugeben oder an die vom Verkäufer zur Abholung Bevollmächtigte zu übergeben, jedoch nicht spätestens 14 Tage ab dem Tag, an dem er vom Vertrag zurückgetreten ist, es sei denn, der Verkäufer hat angeboten, das Produkt selbst abzuholen. Zur Fristwahrung genügt es, das Produkt vor Ablauf der Frist zurückzusenden.

Ein Verbraucher oder Unternehmer mit Verbraucherrechten ist für die Wertminderung des Produkts verantwortlich, die sich aus einer Verwendung ergibt, die über das hinausgeht, was zur Feststellung der Art, der Eigenschaften und der Funktionsweise des Produkts erforderlich ist. Um die Beschaffenheit, Eigenschaften und Funktionsweise von Produkten festzustellen, sollte ein Verbraucher oder Unternehmer die Produkte nur so handhaben und prüfen, wie sie es in einem stationären Geschäft tun könnten.

Vorbehaltlich der Punkte 6 und 8 dieses Absatzes erstattet der Verkäufer den Wert des Produkts zusammen mit den Kosten seiner Lieferung mit der gleichen Zahlungsmethode, die der Verbraucher verwendet, es sei denn, der Verbraucher oder der Unternehmer über die Rechte des Verbrauchers, einer anderen, für sie unverbindlichen Rücksendung ausdrücklich zugestimmt, erfolgt dies ohne Kosten. Vorbehaltlich Punkt 7 dieses Kapitels erfolgt die Rücksendung unverzüglich, spätestens jedoch innerhalb von 14 Tagen nach Zugang der Rücktrittserklärung vom Kaufvertrag beim Verkäufer.

Wenn der Verbraucher oder Unternehmer mit Verbraucherrechten eine andere Versandart für das Produkt als die vom Verkäufer angebotene billigste Standardlieferart gewählt hat, ist der Verkäufer nicht verpflichtet, ihm die ihm entstandenen Mehrkosten zu erstatten.

Hat der Verkäufer nicht angeboten, die Ware beim Verbraucher oder Unternehmer selbst abzuholen, kann er die Rückzahlung der vom Verbraucher erhaltenen Zahlungen zurückhalten, bis er die Ware wieder zurückerhält oder der Verbraucher oder der Unternehmer den Rücksendenachweis vorlegt, je nach Dieses Ereignis steht an erster Stelle.

Ein Verbraucher oder Unternehmer mit Verbraucherrechten, der gemäß Punkt 1 dieses Kapitels vom Kaufvertrag zurücktritt, trägt nur die Kosten der Rücksendung des Produkts an den Verkäufer.

Die vierzehntägige Frist, innerhalb derer der Verbraucher oder Unternehmer mit Verbraucherrechten vom Vertrag zurücktreten kann, beginnt mit dem Tag, an dem der Verbraucher oder Unternehmer mit Verbraucherrechten das Produkt in Besitz genommen hat, und bei einer Dienstleistung mit dem Datum des Abschluss des Vertrages.

Das Widerrufsrecht bei einem Fernabsatzvertrag steht dem Verbraucher oder Unternehmer mit Verbraucherrechten nicht zu, bei einem Kaufvertrag:

bei dem es sich bei dem Leistungsgegenstand um eine nicht vorgefertigte Sache handelt, die nach Spezifikation des Verbrauchers hergestellt wird oder der Befriedigung seiner individuellen Bedürfnisse dient,
-
bei dem es sich bei dem Leistungsgegenstand um einen in einer versiegelten Verpackung gelieferten Artikel handelt, der aus Gründen des Gesundheitsschutzes oder der Hygiene nach Öffnen der Verpackung nicht zurückgegeben werden kann, wenn die Verpackung nach der Lieferung geöffnet wurde,

bei denen Gegenstand der Leistung Gegenstände sind, die nach der Lieferung aufgrund ihrer Beschaffenheit mit anderen Gegenständen untrennbar verbunden sind,
-
bei denen der Gegenstand der Dienstleistung eine Dienstleistung ist, wenn der Verkäufer die Dienstleistung mit ausdrücklicher Zustimmung des Verbrauchers vollständig erbracht hat, der vor Beginn der Dienstleistung darüber informiert wurde, dass er nach Erbringung der Dienstleistung durch den Verkäufer die Recht zum Rücktritt vom Vertrag,

bei denen es sich bei dem Gegenstand der Dienstleistung um einen Artikel handelt, der schnell verderbt oder nur eine kurze Haltbarkeit hat.
